Section 1 Information about the collection of personal data 

(1) We provide access to online media such as internet radio stations, podcasts and selected music services via airable.api.  In the following, we provide information about the collection of personal data when using devices or applications that use the airable API. Personal data means all data relating to you personally, e.g. name, address, e-mail addresses, IP address, user behaviour. 

(2) The Controller as defined in Article 4(7) of the EU General Data Protection Regulation (GDPR) is airable GmbH, Managing Director Heiko Meertz, Am Treppchen 2, 41334 Nettetal, Germany, e-mail address: info@airablenow.com. You can contact our Data Protection Officer using the e-mail address info@airablenow.com or our postal address, marked for the attention of “Data Protection”. 

(3) When you contact us via e-mail or a contact form, we will store your e-mail address and, if you provide it, your name and telephone number in order to answer your questions. We will erase the data that is gathered this way once storage is no longer required, or – in the event of statutory retention obligations – we will restrict processing. 

(4) If we wish to use commissioned service providers for individual functions of our website or use your data for commercial purposes, we will inform you in detail about the relevant processes. We will also provide the defined criteria for the storage period. 

Section 2 Your rights

(1) You have the following rights vis-à-vis us with regard to your personal data: 

  • – Right of access, 
  • – Right to rectification or erasure, 
  • – Right to restriction of processing, 
  • – Right to object to processing, 
  • – Right to data portability. 

(2) You also have the right to lodge a complaint with a data protection supervisory authority regarding the processing of your personal data within our company. The regional data protection supervisory authority responsible for us is the Federal Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia, Kavalleriestr. 2-4, 40211 Düsseldorf, Germany.

(3) When airable.api is used, we collect the personal data described below in order to make the use of the functions more convenient and – if you are using music services – to transmit this data to the music service you are using. If you wish to use airable.api, we will collect the following data. This data is required for technical reasons in order to provide you with the full functionality of airable.api and to guarantee its stability and security (the legal basis for this is Article 6(1f) GDPR): 

  • IP address for the purpose of determining language and location
  • Mac address or device ID to provide associated favourites, search history or settings
  • Control inputs (“play”, “pause”, “next”, “previous” commands) to transmit the functions to the music services
  • Diagnostic data; crash data, known as error logs
  • Username and password of the music service you use in order to be allowed to use the music service / in order to establish the connection to the required music service. These are known as access logs. 

(4) airable.api does not use cookies. 

Section 3 Provision of personal data 

There is no legal or contractual obligation to provide personal data. However, failure to provide the data referred to in section 2(4) above would make it technically impossible for us to provide the airable API service or to provide it with full functionality. 

Section 4 Storage period 

We store your data mentioned in Section 2(4) only for as long as is necessary to fulfil the purposes for which it was collected. The storage period for the data referred to in Section 2(4) is three years. The three-year period begins on the date of your last interaction with airable API. We store enquiries and correspondence with our customer service for five years. Error logs are stored for seven days, access logs for 30 days. 

Section 5 Forwarding data 

We transmit your data to the music service you use via the airable API. Some of these recipients are located in a country where the level of protection for personal data may not be equivalent to that of the European Union (EU) (known as third countries). We only transfer data to recipients in these third countries, i.e. in states outside the European Union (EU), or to international organisations if those recipients have provided appropriate safeguards within the meaning of Article 46 of the GDPR. 

Section 6 Objecting to or withdrawing consent to the processing of your data 

(1) If you have consented to the processing of your data, you can withdraw this consent at any time. Such a withdrawal will affect the lawfulness of the processing of your personal data after you have informed us of your wishes.

(2) Where we base the processing of your personal data on a balancing of interests, you can object to this data processing. This is the case if, for example, processing is not required in order to fulfil a contract with you, which we will illustrate in the following description of the functions. When exercising an objection of this kind, we ask that you provide us with reasons why we should not process your personal data. In the event that your objection is justified, we will check the facts and will either stop or adapt the data processing, or demonstrate to you our compelling legitimate grounds for continuing to process your data. 

(3) You can, of course, object to the processing of your personal data for the purpose of advertising and data analysis at any time. Section 6 No automated decision-making or profiling 

Our processing of your personal data is not connected with any automated decision-making or profiling.
